Question: Is Usâmah bin Lâdin and those who have his opinion and support their ideology considered to be Khawârij?

Shaykh al-Fawzân: You have a principle that says that the one who revolts against the ruler belongs to the Khawârij, regardless of whether it is Usâmah bin Lâdin or anyone else. The one who revolts against the ruler of the Muslims, belongs to the Khawârij.

Imam Ahmad: Here we have the prophet and his companions and the followers (Tabi'un), and Malik among the residents of Hijaz, and ath-Thawri among the Iraqi residents, and al-Awza'i among the residents of Sham, and al-Layth among the egyptians - none of them have said to a man who does not read behind a reading Imam that his prayer is invalid. What should he do? al-Fawzan: If he remembers it shortly afterwards, he should do Sujud-us-Sahw even if it is after Taslim. This significance is in al-Fatihah and other than it. Hammad bin Nasir: All since the time of the companions, the laymen have asked the scholars without them providing evidence for the answer and without condemning that action. Thus, there is consensus that the laymen are allowed to follow the Mujtahidun. (ad-Durar 4/34, afatwa.com)
